15 Year Limited Warranty: Thermopedic^tm

DixieFoam Beds warranties that your Thermopedic mattress will be replaced or repaired, at our option, should it be deemed defective because of structural defects as follows:

This warranty covers deterioration in the cell structure of the visco-elastic (memory foam) material that causes a visible indentation greater than three-quarter inch (3/4”) not associated with a sag in the foundation upon which it is placed. It does not include normal increase of softness in the foam, which c an occur during normal use, or a lessening of the gradual recovery aspect of the memory foam. Such lessening, should it occur, does not reduce the continual pressure reducing and pressure relief properties of the Thermopedic mattress. It also covers any physical flaw in the foam that causes it to split or crack despite normal usage and handling. If such occurs we will, at our option, repair or replace that mattress at a pro-rated charge as follows:

1. For the first 12 months, repair or replacement will be at no charge, excluding specific limitations contained herein.

2. From year two to 15, there will be a charge of 1/180th of the price in effect at the time, multiplied by the number of months used (180 months=15 years).

Our mattress has been designed to work with a firm Box Foundation or Platfoamtm Bed Base. Substituting other foundations that do not have the support characteristics of our foundations will void the warranty, including all other warranties, expressed or implied.

The Limited Warranty applies only if the mattress is in good condition—except for defective materials to be remedied—and not otherwise damaged, abused, misused, burned, soiled or unsanitary. DixieFoam Beds also reserves the right to substitute materials of equal quality in making the repair or replacement

All Service is handled through DixieFoam Beds and it must be given reasonable time to remedy the defect. Transportations costs to and from DixieFoam Beds are the responsibility of the purchaser and are additional to any pro-rated charges. Proof of purchase of any warranty claim is required.

THIS SHALL CONSTITUTE THE EXCLUSIVE WARRANTY TO THE ORIGINAL PURCHASER AND IT SHALL NOT EXCEED IN DURATION THE TERMS OF THE LIMITED WARRANTY. IF THE PURCHASER SELLS THE PRODUCT, THE SUBSEQUENT PURCHASER TAKES THE PRODUCT “AS IS.” WE DO NOT WARRANTY INDIVIDUAL COMFORT PREFERENCES. SHOULD THIS WARRANTY BE EXERCISED AND THE PRODUCT REPLACED AND/OR REPAIRED THAT WARRANTY WILL NOT BE EXTENDED OR RENEWED. THE SOLE DATE APPLICABLE TO THIS WARRANTY TO THE ORIGINAL PURCHASER SHALL AT ALL TIMES BE THE ORIGINAL PURCHASE DATE. NO OTHER WARRANTIES ARE EXPRESSED OR IMPLIED. IN NO EVENT SHALL DIXIEFOAM BEDS BE LIABLE FOR ANY CONSEQUENTIAL DAMAGE OF ANY KIND.

Please retain this warranty and your original invoice for fifteen (15) years.
